Exclusive: Ramin Gray misconduct investigation completed in February

Actors Touring Company received the results of an independent investigation into its artistic director Ramin Gray in February, The Stage can reveal.

The revelation follows recent criticism from two complainants about the way the investigation has been handled, with one claiming it had been left to “fizzle out”.

The investigation into alleged inappropriate behaviour by Gray was launched in November, and was carried out by employment law specialist Lucy McLynn.

McLynn told The Stage: “I was appointed to carry out an independent investigation for ATC, and I delivered my report in February.

“I have not been further involved in any steps taken by ATC as my role ended with the delivery of the report.”

The report has yet to be published – and none of its findings have yet been made public – more than a month after it was filed. ATC is yet to officially confirm that the independent investigation is complete. It is understood that ATC is acting upon legal advice.

On learning of this, one of the complainants, a playwright who wished to remain anonymous, said: “I’m surprised and a bit dismayed they’ve not been on the front foot with this.

“If they’ve had the report that long, surely they could have made some kind of statement or been in touch with claimants? Why the delay?”

A spokesman for ATC said the investigation was only one part of a larger process, and denied that the organisation was on the “back foot” with it.

He said: “It is a simple fact that the different stages take time.

“This is just the way such processes operate and in this regard we are following both legal advice and the advice of the Independent Theatre Council. This doesn’t represent a lack of transparency: it is a result of knowing that there is a limited amount we can discuss without prejudicing the process.”

The spokesman added that ATC does not hold the contact details of those who took part in the investigation, and urged complainants to contact Equity or ITC if they wished to be updated.

Equity declined to comment on the progress of the investigation. The Stage has contacted ITC for comment.

ATC’s statement in full

“An investigation is part of the process, it is not the full process. Far from being on the back foot, the ATC board is fully engaged with this issue, which is of critical importance to us as an organisation, as a responsible member of the wider industry and as an employer.

“It is a simple fact that the different stages take time. This is just the way such processes operate and in this regard we are following both legal advice and the advice of the ITC. This doesn’t represent a lack of transparency: it is a result of knowing that there is a limited amount we can discuss without prejudicing the process.

“Reflecting best practice, ATC does not hold the contact details of those who took part in the investigation. The investigator’s report was anonymised except where a complainant gave their permission to be named, and then only in the report seen by the chair and the board’s legal adviser. The full board received a fully anonymised report. As another example of good practice, ITC monitored all correspondence between the investigator and ATC to ensure transparency of process.

“Protecting anonymity was one of The Stage’s own recommendations for best practice and we wanted to ensure that this was put in place, which it was with the full support and facilitation of Equity. This is to assure confidentiality in the first instance; and to ensure distance and independence so that ATC cannot influence the complainants or the investigation.

“Equity and the ITC have been kept fully informed of the ongoing process and these organisations can be contacted by complainants wishing to be updated.”
